Terms & Conditions

By registering for our services, you acknowledge and agree to abide by these Terms and Conditions.

Overview

The terms “we,” “us,” “our,” and “Maxima Method” refer to EHAB Services GmbH, a limited liability company based in Switzerland. The terms “Customers,” “you,” and “your” refer to individuals using our services. The term “Services” encompasses our training programs (hereinafter referred to as “Programs”), the members-only online platform (maximamethod.com, hereinafter referred to as the “Site”), and other products offered by Maxima Method.

Use of the Services

To access the Services, you must be at least 18 years old and authorized to agree to these Terms and Conditions. Individuals under 18 are not permitted to use the Services. We reserve the right to update or change any content (hereinafter referred to as “Content”), regardless of its source, without prior notice. We do not warrant the accuracy, completeness, reliability, timeliness, or error-free nature of the Content. Maxima Method disclaims any liability for errors, inaccuracies, or omissions within the Content.

Maxima Method operates from Switzerland. Content may not be suitable or lawful outside Switzerland. Accessing the Site from outside Switzerland is done at your own risk, and you are responsible for complying with the laws applicable in your location.

Order of Services

We strive to present and describe our Services accurately. However, the Site may contain inaccuracies or mistakes, which we reserve the right to correct. We also retain the right to refuse or cancel orders with incorrect pricing.

Upon placing an order, we will send you an email confirmation with details regarding the delivery of Services or products. Should there be an error in the confirmation, it is your responsibility to notify us promptly.

Refusal of Services

We reserve the right to deny Services to anyone, at any time, and for any reason, without the need to provide an explanation. Orders are only considered accepted once payment has been successfully processed. We may modify or discontinue aspects of the Services while ensuring prior commitments are honored based on received payments.

Account Creation

To access the Services, you may need to provide personal details, such as your name, email address, and other contact information. You agree to provide accurate, truthful, and current registration details. Impersonating others or using an email address not belonging to you is strictly prohibited. Your account must not be used for unlawful or unauthorized purposes, and you agree to adhere to the laws of both Switzerland and your jurisdiction while using the Services.

Lawful Purposes

You are permitted to use the Services only for lawful activities. You are solely responsible for purchases made by you or on your behalf via Maxima Method. The Site and Services must not be used for any purpose that infringes on the rights of others or violates the law. You are prohibited from posting or transmitting content that is unlawful or infringes on others’ rights.

Cancellations, Refunds & Returns

Purchases of Services, products, or event tickets may or may not qualify for a refund. Access to purchased Services and products is limited to the duration for which fees have been paid and cannot be extended. Any bonuses provided are non-refundable and may be revoked at any time.

Maxima Method, x, Workshops, and Mastermind Groups are strictly non-refundable. By committing to a payment plan for these Programs, you are obligated to complete all payments as scheduled.

Each Service, Program, or product, including events, has its specific refund policy outlined on its respective sales or signup page. Please carefully review these terms before completing your purchase.

If you choose to cancel Services or other products while on a payment plan, you remain responsible for fulfilling all scheduled payments until the balance is fully paid. Cancelling does not waive your obligation to the payment plan.

For late payments, we reserve the right to apply interest charges on the overdue balance. Interest will be calculated according to Article 104 of the Swiss Code of Obligations.

Force Majeure

In the event of delays or failures caused by circumstances beyond our reasonable control, including but not limited to acts of God (“Force Majeure,” e.g., explosions, floods, fires, accidents, wars, terrorism, civil unrest, trade restrictions, embargoes, or pandemics), we will inform you as soon as reasonably possible, detailing the cancellations or delays. Should a Force Majeure event persist for more than 60 days, we reserve the right to terminate the contract with immediate effect. We are not responsible for damages arising from non-delivery caused by circumstances beyond our control.

Materials You Submit to the Site

You must not submit or share on the Site any artwork, photographs, or other materials (hereinafter referred to as “Materials”) protected by copyright, trademark, or other intellectual property rights without obtaining the explicit written consent of the rights holder. The responsibility for determining whether the Materials are protected lies entirely with you. You are liable for any damages resulting from infringements of copyrights, trademarks, or other intellectual property rights, or any other harm caused by such submissions. By submitting Materials to the Site, you warrant that you have the authority to use and share the Materials and that their use or display does not violate any laws, rules, or third-party rights. Should Maxima Method be held liable by a third party for any infringement resulting from your submissions, you agree to fully indemnify Maxima Method, including covering all legal fees and participation in any disputes.

Intellectual Property Rights to Your Materials

We do not claim ownership of the intellectual property rights to Materials you submit to Maxima Method. You retain the copyright and any other legal rights you may hold over any content provided via the Site or Services. However, by submitting Materials to the Site, you grant us a global, non-exclusive, irrevocable license to use the Materials for promotional, business development, and marketing purposes. You also acknowledge that other Customers may utilize your submitted Materials for their purposes. In such instances, you agree to address any claims directly to the infringing party and release Maxima Method from any associated legal liabilities.

Our Intellectual Property

The Services include content and intellectual property owned by Maxima Method, including trademarks, copyrights, proprietary data, and other intellectual property. You are prohibited from modifying, publishing, transmitting, transferring, creating derivative works, distributing, displaying, reproducing, or exploiting any portion of our intellectual property in any format without prior written consent. Copying or imitating our training programs and Services for personal or commercial use is also strictly forbidden. We reserve the right to immediately remove you from the Services, without refund, if you are suspected of violating our intellectual property rights.

The following are registered trademarks, common law, or statutory trademarks of Maxima Method or its affiliates: Maxima Method, and any other publicly registered trademarks not listed here, including new Services, trademarks, and programs developed and introduced on the Site in the future. All custom graphics, icons, logos, and names associated with the Services are also considered proprietary trademarks of Maxima Method. All other trademarks belong to their respective owners. These Terms and Conditions do not grant you any rights to use Maxima Method’s trademarks, logos, or service marks. Protecting our intellectual property is a top priority, and we will take legal action to safeguard our interests and seek appropriate damages.

Confidentiality and Data Protection

Information shared through the Services is not considered confidential and may be visible to other Customers. For confidential matters, please communicate directly with designated Maxima Method employees and explicitly state that the information is confidential.

We may use submitted Materials for analytical purposes, to improve our Services, Programs, and products, and to create effective marketing tools.

Please note that coaching calls, webinars, and other audio or visual content may be recorded and used by Maxima Method for business, promotional, or product purposes unless you specifically request otherwise. To make such a request, please email info(at)maximamethod.com.

Warranty and Liability

Maxima Method delivers its Services with professional care and expertise but does not guarantee specific outcomes or success. Maxima Method assumes no responsibility for financial or economic losses or reliance on provided advice. You understand that individual results may vary depending on factors such as background, dedication, and external market conditions.

Maxima Method is not accountable for third-party information provided during Programs or posted on the Site. Such third-party information does not reflect Maxima Method’s views, and we cannot guarantee its accuracy or reliability.

Any liability related to the Services is excluded to the fullest extent permissible by law. This includes both direct and indirect damages. Liability for intentional misconduct or gross negligence is reserved. Maxima Method is not responsible for damages due to Force Majeure or unauthorized third-party actions (e.g., hacking).

Where liability exclusions are not enforceable, Maxima Method’s liability is limited to the total fees you paid for Services directly related to the claim.

Third-Party Resources

The Site and Services may contain links to third-party websites or resources. You acknowledge and accept that Maxima Method is not responsible for the availability, accuracy, content, or policies of these third-party resources. Links to such resources do not imply endorsement or affiliation. You assume all risks associated with using these third-party sites.

Survival of Provisions

Certain provisions of these Terms and Conditions remain in effect beyond the termination of the contract. These include, but are not limited to, clauses on intellectual property, liability, and applicable law.

Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages, costs, or expenses (including legal fees) resulting from your breach of these Terms and Conditions or your use of the Site or Services. You will assist us, at no charge, in defending such claims, providing all relevant information and materials as requested. Settlements or waivers cannot be made without our prior written consent.

Notices may also be sent to the email or postal address provided during your registration. Broadcast messages on the Site regarding updates or significant matters will also constitute sufficient notice.

Electronic Communications

By using the Site or communicating with Maxima Method via email, you consent to receive electronic communications. These include notices, agreements, and disclosures, which satisfy any legal requirement for written communication.

Exclusivity of Terms and Conditions

These Terms and Conditions exclusively govern the relationship between the parties. Any conflicting customer terms are explicitly excluded.

Severability

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in effect. Invalid clauses will be replaced with valid terms that closely reflect the original intent.

Amendments to Terms and Conditions

Maxima Method reserves the right to amend these Terms and Conditions at any time. Changes will be appropriately communicated and deemed accepted unless you object within 30 days. Objections will be treated as extraordinary termination, with no refunds for Services rendered before termination.

Applicable Law and Place of Jurisdiction

These Terms and Conditions are governed by Swiss law, excluding the Vienna Sales Convention (CISG).

The exclusive place of jurisdiction is Maxima Method’s registered office. In cases where Swiss law or jurisdiction is unenforceable, disputes will remain subject to the maximum extent of Swiss law allowed in the relevant jurisdiction.
